STORAGE AND PICKUP TERMS AND CONDITIONS

Please review these terms and conditions (“Terms” or “Agreement”) which apply to pickup orders, including but not limited to the storage, handling, and pickup of merchandise.

IMPORTANT NOTICE: THESE TERMS INCLUDE A CLASS ACTION WAIVER, WHICH REQUIRES ALL DISPUTES TO BE RESOLVED INDIVIDUALLY RATHER THAN AS A CLASS OR COLLECTIVE ACTION.

 
COURTESY STORAGE

At My Luxury Flooring, we understand that transporting your high-quality flooring materials may require multiple trips. We offer up to 7 days of free storage for your order. After this period, a storage fee of $10 per day will apply until the order is fully picked up. Any applicable storage fees must be paid in full before materials will be released.

 
IN-STORE PURCHASES

To collect your order, you must present the original purchase receipt. My Luxury Flooring reserves the right to hold any merchandise until ownership is verified. If someone other than yourself (e.g., a contractor or delivery service) is picking up your order, you must authorize them by providing their details at the time of purchase. Authorized pickup persons must present a valid government-issued photo ID for verification. My Luxury Flooring may collect certain information, such as name and issuing state, to verify identity and prevent fraud.

 

ONLINE PURCHASES

For online orders, you must provide the following at the time of pickup:

  1. Online sales receipt
  2. Government-issued photo ID
  3. Purchasing credit card used for the transaction

For third-party pickups, the authorized individual must present these same items and fill out the necessary authorization form.

 

LOADING AND SECURING OF MERCHANDISE

Customers are responsible for providing a safe and adequate vehicle for transportation. While My Luxury Flooring offers courtesy loading assistance, customers must ensure:

  • Their vehicle can handle the weight and volume of the materials.
  • They stop an employee if they feel the load is unsafe.
  • They properly secure the merchandise before leaving.

My Luxury Flooring is not responsible for any damages to vehicles or merchandise after loading. Customers must stand at least ten feet away from any equipment or machinery in operation and assume full responsibility for transport.

 

PRODUCT ACCURACY VERIFICATION

INSPECT YOUR ORDER BEFORE LEAVING THE STORE. Customers must verify:

  • Product type, quantity, and model number
  • Color and dye lots (for porcelain and ceramic products)
  • Labels on wood products

Any discrepancies must be reported before leaving the premises. By signing the receipt at pickup, you confirm that the order is complete and accurate. No claims will be accepted after departure.

 

COMMUNICATIONS

By placing an order, you agree to receive notifications via phone, email, or SMS regarding order status, pickup, or delivery. These communications are for informational purposes only.

 

CURBSIDE PICKUP SMS TERMS

By texting us for curbside pickup, you agree to receive SMS messages regarding order status. To stop messages, reply STOP at any time. For assistance, reply HELP or contact Customer Support. Standard message and data rates may apply.

 

INFORMAL DISPUTE RESOLUTION

Before initiating any formal dispute resolution, both parties must attempt to resolve the dispute through good-faith negotiations within 30 business days of written notice. The notice must include:

  • Full name and contact details
  • Description of the dispute and transaction details
  • Requested resolution

This dispute resolution process is mandatory before proceeding with formal action.

 

CLASS ACTION WAIVER

All disputes between customers and My Luxury Flooring must be resolved on an individual basis. Class-action lawsuits, collective claims, and representative actions are strictly prohibited. If a court deems this waiver unenforceable, the affected claim must be litigated in court, while other claims remain subject to these terms.
